1. Introduction and Acceptance of Terms
- (a) Welcome to Global Players Network Pty Ltd ABN 41 102 371 335 (trading as The Lottery Office) Account terms and conditions (Terms) that govern your use of your Account and our Lotteries.
- (b) Our registered office of address and data center is located in Darwin, Northern Territory of Australia where we are licensed and regulated by the Northern Territory Government of Australia to sell our Lotteries both in and outside the Northern Territory, Australia.
- (c) We also have a services office in Gold Coast, Queensland. You can contact us at any time by emailing support@lotteryoffice.com.au or you can also contact us through LiveChat or by phone on (07) 2111 8242, Monday to Friday, between 09:00 and 17:00 (AEST). Alternatively, feel free to utilise the contact form on our Website.
- (d) Our licence number is IGL1001. You can confirm our licence arrangement by calling Licensing, NT on +61 8 8999 1800 or alternatively visiting the licensing website here. Licensing, NT is responsible for the regulation, oversight and auditing of our operations and our Lotteries. We have also included a link to Licensing NT where you can search the public register here. All you simply need to do is include our licence number, select "Gambling Business" for Licence Scheme and type "Global Players Network Pty Ltd" for "Licensee Name" and hit the search button. It will show that we have an Internet Gaming Licence and that our status is "current".
- (e) In these Terms, "us", "we" and "our" means The Lottery Office and our Related Bodies Corporate (as defined in the Corporations Act 2001 (Cth)). "You" and "your" means you, the Account Holder.
- (f) The Terms govern all aspects of your transactions and interactions with us relating to your Account. By establishing an Account, you represent to us that you have read, understood and agree to be bound by these Terms.
- (g) These Terms are subject to the Act and the Rules. In the event of any conflict between the Act, Rules and/or these Terms, the first listed will prevail to the extent necessary to resolve the conflict.

2. Eligibility
- (a) Participants must be at least 18 years of age (or older if required by any law applicable in your place of residence or in any jurisdiction in which you are located when transacting with us).
3. Website and App
- (a) Our Website and App Terms of Use can be found here. You acknowledge that you have read, understood and agree to be bound by the Website and App Terms of Use incorporated into these Terms.
4. Registration

(a) To purchase Lotteries from us through our Website and/or App, you must apply for an Account and be registered as an Account Holder. You can only make an Application for an Account:
- (i) if you are an individual person;
- (ii) if you are at least 18 years of age (or older if required by any law applicable in your place of residence or in any jurisdiction in which you are located when transacting with us);
- (iii) if you are not currently excluded from acquiring our Lotteries for any reason; and
- (iv) where such registration and the opening of an Account with us does not contravene any law applicable to your place of residence or in any jurisdiction in which you are located when transacting with us.

(b) If, we accept your Application to open an Account, we will open an Account in your name. Subject to clause 10, this Account will be your digital wallet on the Website and App where:
- (i) you can deposit funds to be used to purchase our Lotteries;
- (ii) we issue and register your entries; and/or
- (iii) we pay any prizes or other funds.
- (c) You will be registered as an Unverified Account Holder for your Account until such time as your name and date of birth have been verified in accordance with our identity verification procedures at which time we may register you as a Verified Account Holder.

(d) It is your responsibility to inform us of any changes to the information you have given to us while your Account is active. We rely on this information to be true, correct and not misleading. If, the information is untrue, incorrect and/or misleading:
- (i) we may cancel or suspend your Account;
- (ii) we may cancel and dishonour any Lottery purchases or offers to purchase our Lotteries made by you; and
- (iii) where you have committed a serious breach of these Terms, including a breach of law, we may retain or recover from you the value of those Lotteries purchased and any winnings paid to you.

(e) If you are prohibited by any relevant law from accessing or using our Website and /or App to purchase our Lotteries, we do not agree to accept:
- (i) your Application for registration of Account;
- (ii) your deposit of funds; and/or
- (iii) your offer to purchase our Lotteries or pay you any winnings,
- (f) We reserve the right at our sole discretion to refuse your Application to open an Account. Our government licence, the law, regulations and these Terms may mean that some individuals are ineligible to apply.
- (g) If we become aware that you are under the age of 18 years old or prohibited from having an Account with us due to providing false or misleading information and documentation on your Application we will immediately terminate your Account. Any funds held in your Account (including prize winnings) will be paid to the Regulator. If your funds have been sent to the Regulator, it is your responsibility to contact the Regulator to recover your funds.
- (h) To ensure the integrity of some Lottery Draws, it is possible that key employees or agents of ours may be notified that they are not permitted to open an Account with us.
5. Your Account
- (a) You may only have one Account with us in your name. If we reasonably believe that you have more than one Account in your name, we will notify you promptly and provide you with the opportunity to choose which Account to keep before combining the balance of those Accounts and closing the duplicate Account.
- (b) When you apply to register your Account you will be requested to provide your email address and create a password. To access your Account and purchase our Lotteries, you must authenticate your identity by either entering your email and password or using such alternative authentication mechanism as we may make available from time to time.
- (c) You must not disclose your password or other verification information to anyone.
- (d) It is your responsibility to ensure that no other person accesses your Account using your password or such alternative authentication mechanism. You are responsible for any use of your Account, including but not limited to, any person purchasing Lottery Tickets and the associated costs. We will not be liable to you for any Loss that you suffer as a result of another person accessing or using your Account, in this regard, your Account will be charged accordingly for such purchases and any associated fees and charges (if applicable).
- (e) If you inadvertently disclose your password or authentication details to anyone or there has been a security breach or unauthorised use of your Account, you should immediately contact us and change your password.
- (f) You may change your password at any time by accessing your Account settings through our Website and/or App. You may provide other verification information or suspend your Account at any time by contacting us as set out on our Website and/or App.
- (g) You agree not to create an Account for anyone else or use the Account of another Account Holder. You are solely responsible for the activity that occurs within your Account.
- (h) Any deposits you make to your Account can only be used to play our Lotteries and cannot be withdrawn from your Account unless otherwise agreed in writing between you and us. Only prize winnings deposited into your Account by us can be withdrawn from your Account.
- (i) You cannot operate your Account as a bank account. We are subject to certain laws, regulations and our government licence on how your Account can be operated and you acknowledge and agree that limitations will apply to the use of your Account.
- (j) We may temporarily block your Account if we consider that a withdrawal request or the continued operation of such Account is illegal or constitutes an offence under these Terms. We may also withhold payments of any nature and void all your winnings if you have committed a serious breach of these Terms, including where there has been a breach of law that cannot be rectified.
6. Entry
- (a) All purchases of our Lotteries are made between you and us in Darwin, Northern Territory, Australia unless otherwise specified in writing by us.
- (b) Your purchase of our Lotteries is formed and governed by the laws of the Northern Territory, Australia.
- (c) If you wish to place an entry for our Lotteries, you must complete the entry form in accordance with the instructions found on our Website or App. You must check the entry form you have completed including the total number of games and cost prior to submitting the entry form via your shopping cart and making payment.

(d) Your shopping cart will contain the following:
- (i) the name of the Lottery;
- (ii) the details of the next available draw for the Lottery;
- (iii) the cost of each Lottery entry; and
- (iv) the total cost of your Lottery Ticket.
- (e) Your shopping cart, if left unattended and not submitted for processing for a select period determined by us will be automatically deleted. You will receive prompts from us prior to your shopping cart being automatically deleted.

(f) When we have received clear, unencumbered payment from you credited to our Northern Territory bank account for the purchase of our Lotteries via the Website and/or App, we will:
- (i) issue you with a Lottery Ticket in accordance with your entry form for our Standard Lotteries; or
- (ii) purchase relevant games in Foreign Lotteries that match your chosen International Lottery Tickets in accordance with your entry form and these Terms. We will retain and own the Foreign Lottery Ticket and we will issue you with our own separate International Lottery Ticket that is identical to the Foreign Lottery Ticket we have purchased. For the avoidance of doubt, you acknowledge that you will not own any Foreign Lottery Ticket and will make no claim in relation to the same.
7. Our Lotteries
We operate and provide two types of Lotteries, namely:

(a) Standard Lotteries
- (i) means lotteries that are not matched with Foreign Lotteries and conducted in accordance with these Terms, as notified from time to time.

(b) International Lotteries
- (i) means the International Lotteries matched with Foreign Lotteries and conducted in accordance with these Terms, as notified from time to time, and specified in the table below:

You understand that you will not receive a Foreign Lottery Ticket, but instead receive an International Lottery Ticket in the relevant matched International Lottery conducted by us. Our International Lottery Ticket in Australia has the same possible winning numbers; at an approximate time and date aligned with the publication of the Foreign Lottery; the same number draw methodology; the same possible winnings outcome and the same value of prize money payable if it is a winning ticket as the Foreign Lottery Ticket we purchased;
- (iv) a Foreign Lottery is conducted by a lottery operator in a country outside of Australia. It is regulated by the government of that country where the draw takes place;
- (v) all matching Foreign Lottery Tickets are owned by us, and you are not entitled to receive or have ownership of those tickets. We are not your agents in purchasing the Foreign Lottery Ticket. We will issue you an International Lottery Ticket equivalent to the Foreign Lottery Ticket in accordance with clause 7(b)(ii);
- (vi) the International Lottery Ticket we issue to you in accordance with this clause, in the event you have a winning Lottery Ticket, entitles you to collect the exact same amount of prize money that we received on the Foreign Lottery Ticket (subject to any deductions for local taxes in that jurisdiction);
- (vii) we do not take bets on lottery outcomes in a Foreign Lottery;
- (viii) the outcome of our International Lotteries in Australia are dependent upon, and will be drawn to match, the outcome of the equivalent matched Foreign Lottery draw which is performed by the foreign lottery operator. Therefore, our International Lotteries in Australia are subject to the terms and conditions of the relevant Foreign Lottery and you acknowledge and agree that we are bound by the relevant terms and conditions of the relevant Foreign Lottery;
- (ix) you acknowledge and agree that if, for any reason, the Foreign Lottery operator fails to deliver a relevant prize to us, we will not be under any obligation to pay a corresponding amount to you; and
- (x) we cannot offer a ticket cancellation option once we issue you with an International Lottery Ticket and an entry has been placed and paid for by us in the matching Foreign Lottery due to the complex process and rigorous timelines approved by the Regulator. You must verify the details and cost of the Lottery Tickets you are purchasing before placing an entry.

(c) Systems
Lotto systems contain special features enabling you to:
- (i) select more than the required standard draw numbers to be played in a game; or
- (ii) select fewer than the required standard draw numbers with missing numbers to be filed with every possible outcome in a game,
each of which are specified in more detail for each Lottery on our Website in accordance with the relevant Rules and Terms.

(d) Syndicates
Lotto syndicates, also known as a group entry, refers to a group of players who pool money to purchase Lottery Ticket(s). All participants in a Lottery syndicate agree to share any prize winnings proportionately based on their contribution(s). We are responsible for managing the Lottery entries, issuing the relevant Lottery Ticket(s), collecting payments and distributing any prize winnings. We are not liable for any disputes arising within the syndicate. Syndicates are specified in more detail for each Lottery on our Website in accordance with the relevant Rules and Terms.

(e) Combos
Lotto combos allow you to participate in multiple Lotteries through a single transaction. Each Lottery within the combo is treated as a separate Lottery entry. Prizes are awarded based on the winning numbers drawn for each individual Lottery. We are not responsible for errors in the selection or submission of your combo entries. Combos are specified in more detail for each Lottery on our Website in accordance with the relevant Rules and Terms.
8. Draw
- (a) Our Lotteries are conducted in Darwin, Northern Territory of Australia under supervision of the Regulator.
- (b) When you purchase a Lottery Ticket in an International Lottery that is matched to a Foreign Lottery in accordance with clause 7(b)(i), the matching draw also takes place in Darwin, Northern Territory, Australia. This occurs after the outcome of the relevant Foreign Lottery draw is entered into our approved lottery system(s), and winning Lottery Tickets are identified and declared from our database.
9. Cut-Off Time
- (a) Cut-off times for each of our Lotteries are displayed on our Website and App. We retain the right, in our sole discretion, to determine the cut-off times. If a cut-off time for a particular Lottery Draw has expired, all entries submitted for that Lottery will be processed for the next available draw.
10. Prizes and Currency
- (a) All prizes and ticket costs are in Australian dollars unless otherwise stated.
- (b) All jackpots quoted on our Website and/or App for International Lotteries have been converted to Australian dollars daily with the prevailing daily exchange rate. The jackpot prizes advertised may differ slightly from day to day due to exchange rate fluctuations.

(c) Subject to clause 10(f), all prizes for our International Lotteries are payable as follows:
- (i) All prize winnings under A$10,000 will be paid in Australian dollars converted at the prevailing exchange rate at the time we conduct our Lottery Draw and deposited into your Account within 24 hours; or
- (ii) All prize winnings of A$10,000 or more will be paid in Australian dollars converted at the prevailing exchange rate on the day we collect the winnings from the matching Foreign Lottery Ticket and deposited into your nominated bank account.

(d) Subject to clause 10(f), all prizes for our Standard Lotteries are payable as follows:
- (i) All prize winnings under A$10,000 will be paid in Australian dollars at the time we conduct our Lottery Draw and deposited into your Account within 24 hours; or
- (ii) All prize winnings of A$10,000 or more will be paid in Australian dollars at the time we conduct our Lottery Draw and deposited into your nominated bank account within two weeks of the Lottery Draw.
- (e) New Zealand customers payment of a Lottery Ticket will be made in Australian dollars in accordance with the exchange rate set by your bank or financial institution.
- (f) Any major prize in our Standard and International Lotteries is subject to verification procedures prior to any payment being made. You must provide us with the required verification documentation to allow us to pay any prize winnings in accordance with clause16(a). If you are an Unverified Account Holder, you are not eligible to collect your prize winnings until you have completed our verification requirements.
- (g) If you have nominated a bank account to pay any prize winnings to and the nominated bank account is held jointly with other person(s), we will not be held liable to you for payment of prize winnings to this nominated bank account.
11. Insufficient Funds
- (a) If you have insufficient funds to pay for an entry, the amount of the shortfall cost will be displayed together with the payment method options to complete the transaction.
- (b) You may choose to purchase using available funds in your Account with the remaining balance required to be deposited to top up the Account to complete the transaction.
- (c) If there are no available funds in your Account, you must choose to pay the full cost of the entry by the payment method options available to you to complete the transaction.
12. Lottery Tickets unpaid
- (a) If we are not paid the relevant Lottery Ticket cost, your entry is deemed void. You will not be entitled to any prize winnings. This applies irrespective of whether the non-payment of the Lottery Ticket cost is a result of you or a Third-Party action or omission, whether deliberate, accidental or otherwise, such as, cancelling a credit card payment.
- (b) We reserve the right to recover the unpaid Lottery Ticket cost, value of any prize winnings paid to you and all reasonable costs incurred as a result of legal and/or debt recovery action taken against you.
- (c) In our sole discretion, an unpaid Lottery Ticket cost may be entered as a debt or withdrawn from your Account against any future funds deposited by you or prize winnings.
13. Your Lottery Ticket
- (a) Once an entry form has been submitted and the cost of the entry form has been received by us, we will process your entry. The details of your entry form will be contained in the "My Draws" tab of your Account on the Website and App, which serves as the primary location for viewing and verifying your ticket details. While we may also send confirmation emails as a courtesy, these are not guaranteed, and we encourage you to rely on the "My Draws" tab for the most accurate and up-to-date information about your entries.
- (b) If a Foreign Lottery Ticket is not able to be immediately purchased by us, the entry form will be identified as a "Pending" entry in the "My Draws" tab of your Account on the Website and App. The "Pending" status will remain until we have received confirmation that the ticket has been purchased. The Lottery Ticket will be displayed in the "My Draws" tab once we have received this confirmation. If the relevant Foreign Lottery Ticket cannot be purchased by us prior to the cut-off time/date for the relevant Foreign Lottery, clause 14(c) will apply.
14. Failure to Process an Entry
- (a) If an entry cannot be processed by us due to a failure in your chosen payment method, you will be notified immediately by way of a "pop-up message".
- (b) Your entry will be processed for the next available draw after we have received payment for your entry.
- (c) In the unlikely event of an entry not being able to be processed for the relevant Lottery due to technical issues or an issue outside our reasonable control, the funds received for that entry will be placed back into your Account. We will notify you by email should this occur. We will not be held liable to you for any Losses where clause 14(c) applies to your Lottery entry, to the fullest extent permitted by law.
15. Unverified Account Holders
- (a) The Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (AML/CTF Act) requires online gambling operators to verify their customer details within 14 days of the customer opening an Account. Your Account is opened when you make your first deposit for Lottery purchases under the Account number allocated to you. Although Lotteries are generally exempt from the requirements of the AML/CTF Act, in the spirt of cooperation with authorities we also attempt to verify your identity within 14 days. The verification checks we undertake of you form part of our responsible gambling policy and a requirement from our Regulator. You cannot withdraw prize winnings from your Account until verification is complete. We place strict spending limits on Unverified Account Holders.
- (b) Unverified Account Holders are those players whose identity has not been verified in accordance with the requirements of the Regulator. The verification is initially undertaken by us through approved Third-Party organisations. You agree that, in order to enable us to undertake this verification, we may, in accordance with our Privacy Policy, securely disclose your personal details to Third Parties who are approved organisations that assist us to verify your identity including credit reporting agencies.
- (c) Once the verification process has been successfully completed, you will be classified as a Verified Account Holder.
- (d) If satisfactory verification is not achieved, we may require you to provide additional proof of identity in an acceptable form which may include government issued photo identification. An Unverified Account Holder cannot make deposits to their Account in excess of A$500 and are prohibited from making withdrawals of any prize winnings from their Account.
16. Verified Account Holder
- (a) If you are a Verified Account Holder, you may be required to supply additional identification including government issued identification and proof of ownership of your bank account where you have prize winnings of A$10,000 or more. This requirement is in accordance with the AML/CTF Act. The additional verification requirements must be met before the win can be paid to your nominated bank account.
- (b) The maximum allowable balance for funds deposited by you into your Account is A$5,000.
- (c) The maximum allowable amount deposited by you into your Account in a single transaction is A$3,000.
- (d) If you are a Verified Account Holder, you may withdraw your winnings from your Account by any of the services we make available from time to time in the manner shown within our Website/App.
17. Account Balance Limitations
- (a) If prize winnings take the balance of your Account over A$6,000, you may use that credit balance for future Lottery game purchases for a period of a month. Subject to clause 10(f), thereafter, any balance over A$6,000 must be paid to your nominated bank account.
- (b) All payments by us to you in excess of A$10,000 must be made by electronic payment.
18. Account Imposed Spend Limits
- (a) You may choose to set a weekly spend limit and can do so when you log into your Account. Weekly spend is a rolling 7-day calculation.
19. Suspension or closure of your Account
- (a) You may close your Account at any time by following the Account closure procedures in the "My Account" section of our Website or App or alternatively you can contact our Customer Support Team via the contact instructions on our Website or App.
- (b) We may suspend or close your Account without notice and at any time, in our absolute discretion, in accordance with the law, regulations, a request from the Regulator, these Terms, activity on your Account that gives rise to reasonable suspicion of unauthorised use of credit or debit cards, and our responsible gambling requirements. Subject to these Terms, your rights with respect to any funds held in your Account will survive termination, suspension or closure of your Account.

(c) If your Account is suspended, you will not be able to:
- (i) deposit funds;
- (ii) purchase Lotteries using funds standing to the credit of your Account; and/or
- (iii) withdraw funds from your Account, until the suspension of your Account is lifted. We are not liable to you for your inability to use your Account while its suspended.
- (d) In accordance with government regulations, if your Account has been inactive for a period of six months, we will attempt to make contact with you by the nominated email address and/or phone number you supplied to us to determine your intentions with respect to your Account.
- (e) If your Account has been inactive for a period of three years without a satisfactory reason, we may in our absolute discretion close your Account. If the Account is to be closed, other than for a breach of these Terms, the law and/or regulations, we will attempt to make contact with you by the nominated email address and/or phone number you supplied to us to advise that any funds held in your Account will be paid to your nominated bank account if your Account is not reactivated by a date nominated by us.

(f) Upon closure of your Account:
- (i) The balance of your Account will be paid either to you via Bank Transfer (if those details are available) or to the Regulator in accordance with our approved control procedures;
- (ii) If an inactive Account is closed by us and you cannot be contacted or your current address confirmed, the balance of your Account will be forwarded to the Regulator;
- (iii) If the closure of your Account is due to you being impacted by gambling harm, all of the balance in your Account will be paid to you via Bank Transfer (if those details are available);
- (iv) In all other cases of Account closure, subject to any recovery of funds to us permitted under these Terms we will pay all funds held in your Account to you provided such payment is permitted under our approved control procedures. An example of such customer payment not being permitted may be due to activity in an Account that is deemed to be suspicious and in breach of law, regulations or government policies, procedures or rules. In this case, the entire balance of the Account will be paid to the Regulator. The Regulator in its absolute discretion will determine the appropriate course of action, which may include investigating the source of the funds, freezing the Account, or initiating legal proceedings. The Regulator's decision will be final and binding, and any appeals or challenges to this decision will be subject to the laws and regulations in force; and/or
- (v) Payments to you upon closure of your Account except for Accounts closed impacted by gambling harm may be subject to a minimum withdrawal amount based on the cost of the transfer fees.
- (g) Once your Account is permanently deactivated/closed for gambling harm reasons, the Account cannot be reopened.
20. Depositing Funds into your Account
- (a) Funds deposited in your Account can only be used to purchase future Lottery Tickets from our Website or App and are not available for withdrawal unless otherwise agreed in writing between you and us.
- (b) Bonuses credited to your Account can only be used to purchase future Lottery Tickets from our Website or App. You cannot withdraw the cash equivalent or monetary value of any unused bonus from your Account. Any bonus amount in your Account will be forfeited upon Account closure. The issue and use of any bonus is solely at our discretion.
- (c) Where free play is advertised as part of our offer, the free play will be funded by bonus money deposited into your Account notwithstanding that we may have to outlay money to pay for the Lottery Tickets. Free play and bonuses will be revoked and invalid if the Lottery Tickets that were purchased to qualify are not fully paid.
- (d) Subject to these Terms, you may at any time withdraw any winnings in your Account, or any part thereof, subject to any minimal withdrawal amount that may apply, by selecting your preferred withdrawal method.
- (e) You shall be solely responsible for the reporting and payment of any and all taxes and charges arising from or imposed on amounts paid or transferred to you. You acknowledge and agree that where necessary we may retain a portion of your prize winnings and forward it to the appropriate tax authority on your behalf.
- (f) We may change the way deposits can be made (including cancelling or suspending any deposit method) at any time and we will notify you of these changes as soon as practicable.
- (g) When you make a deposit with us you are using a facility offered by one or more Third Party providers and your use of those Third Party providers are subject to the terms and conditions of use stipulated by them.
- (h) Deposit of funds into your Account will only be recognised when we have received confirmation from the Third Party provider that the funds have been cleared for our use.
- (i) We try to ensure that the balance of your Account is correct at all times. Nevertheless, you should check the balance of your Account and transaction history frequently and bring any apparent disparity to our attention immediately by contacting us.
- (j) No interest will be payable by us on funds standing to the credit of your Account.
- (k) In the event that funds are credited to your Account in error, it is your responsibility to notify us of the error at the earliest opportunity. Unless we notify you to the contrary, any transactions resulting from the error will be void.
21. Results of Lottery Draws
- (a) Following each Lottery Draw, we will publish the final and conclusive winning numbers on our Website and App.
- (b) For International Lotteries, your winning Lottery Ticket from us will entitle you to prize winnings equal to the amount which is paid to us for the matching winning Foreign Lottery ticket. We use all reasonable efforts to publish all official Lottery Draw results, including the winning numbers and prize amounts, on our Website and App as soon as reasonably practicable following official publication by the related Foreign Lottery operator. You acknowledge that due to Foreign Lottery results being based on information we must collect from a Third Party provider, such information may be incorrect, incomplete, and subject to change.
- (c) For our Standard Lotteries, the Lottery Draw will be conducted at a time in accordance with relevant Lottery Rules as published on our Website. The prize amounts will be the percentage of the prize pool specified for each prize division in those Rules. We will publish those winning numbers and prize amounts on our Website and App as soon as reasonably practicable following the Lottery Draw.
- (d) If you have a prize winning Lottery Ticket you will be notified via email to your nominated email address and phone number as a courtesy. However, the primary method for checking results of the Lottery Draw and confirming any winnings is through the "My Draws" section of our Website and/or App. For significant division wins, our customer support team may also contact you directly by phone.
22. Taxes, Fees and Charges
- (a) Matched Foreign Lottery prizes may be subject to local tax in the jurisdiction of the Foreign Lottery operator. You are encouraged to look at the information we have provided on our Website regarding how local tax may reduce the cash value of any prize amount advertised for a Foreign Lottery. We will not provide any warranty on the currency or accuracy of this information.

(b) Where a Foreign Lottery operator offers a first division prize with the options of that prize being paid by annuity installments or by way of a single lump sum:
- (i) If the Foreign Lottery operator offers a facility to convert the annuity to a residual lump sum during the term of the annuity, then we may, with the agreement of the Regulator, elect to offer the annuity payment option to you;
- (ii) Should we then, at any time, intend to cease trading or should you make a request to convert the annuity payment plan, then we will, at the applicable time, instruct the Foreign Lottery operator to convert the remainder of the first division prize from an annuity payment to a residual lump sum in accordance with their conversion procedures in place at that time and pay that amount to you;
- (iii) If the Foreign Lottery operator does not offer such a conversion facility, then we cannot offer the annuity first division prize payment option, and you will only be entitled to a payment equal to the lump sum first division prize.

(c) You are encouraged to review the information provided on our Website regarding how annuity and lump sum cash payments of any prize amount for an International Lottery (matched against a Foreign Lottery) is determined. Generally, the cash option represents the cost incurred by the Foreign Lottery operator to purchase the annuity associated with the prize. This cost may fluctuate based on several factors, including but not limited to:
- (i) The term or length of the annuity; and
- (ii) Current inflation and interest rates and commodity investment prices,
- (d) You should be aware that we may not be able to pay out promotional prizes offered by a Foreign Lottery, as such prizes may only be available in the country where that Foreign Lottery is based. If we are able to claim a promotional prize from a Foreign Lottery in relation to a winning ticket held by you, we will pay that promotional prize to you.

(e) Except where otherwise specified, we reserve the right to recover from you any fees, costs, losses, charges, taxes, imposts, levies or duties imposed on us by a Third Party and which we incur:
- (i) in providing services to you;
- (ii) in respect of the Lotteries purchased by you;
- (iii) in relation to a deposit of funds credited to your Account, including charges arising from credit card transaction fees and charges in obtaining authorisation or confirmation from the relevant financial institution that the funds will be credited to our bank account;
- (iv) if a deposit of funds credited to your Account is made fraudulently, incorrectly or in an unauthorised manner; or
- (v) in transferring funds to you from your Account,
- (i) demand in which case the relevant amount will be payable on demand; or
- (ii) debiting your Account by the relevant amount, subject to any limitation imposed by law.
23. Prize Entitlement
- (a) Solo Play: A solo first division or secondary prize entitlement can only be awarded to a singular player owning the Lottery Ticket.

(b) Syndicate Play: When you buy into a syndicate play, you buy either one share or as many shares as you want subject to availability, and all other syndicate players can do the same. Funds from the sale of the shares in the syndicate are combined to purchase and play a larger number of game entries. A larger number of game entries may increase your chances of winning. All syndicate play entitlements will always be divided by the number of shares that are in that syndicate. Our syndicate play options offered for select Lottery Draws will display:
- (i) the fixed numbers of shares in that syndicate play into which any prize entitlements will be equally divided;
- (ii) the stated number of tickets that will be bought for that syndicate play;
- (iii) the cost per share of the syndicate play which will depend on the number of tickets to be purchased; and
- (iv) the number of shares in the syndicate still available to be purchased.

(c) Lotto Systems: Lotto systems contain special entry features including enabling you to:
- (i) select more than the required standard draw numbers to be played in combination; or
- (ii) select fewer than the required standard draw numbers with missing numbers to be filled with every possible outcome,
24. Charity Fund Donations
- (a) At our sole discretion, a percentage of all Lottery Ticket sales may be donated to Australian & New Zealand charities of our choice. We may publish the amount and who we donated to on our Website.
25. Intellectual Property Rights
- (a) We refer you to our Website and App Terms of Use with respect to our intellectual property rights.
26. Disclosure
- (a) We reserve the right to access, interpret, preserve and disclose any information that we obtain in connection with these Terms, the Website and App and your use thereof, as we reasonably believe is necessary to satisfy any applicable law, regulation, legal process, subpoena, governmental request or government licence requirement.
- (b) We reserve the right to enforce these Terms, including but not limited to the investigation of possible violation of these Terms. In doing so, we may identify, prevent or otherwise address fraudulent activity, security or technical issues and report investigation outcomes to the appropriate authorities.
- (c) We will respond to your requests for support. We will protect our rights, property, our users and/or the public.
27. Responsible Gambling and Self-Exclusion
- (a) We maintain, support and uphold an ongoing commitment to approved responsible gambling policy and procedures. We prohibit anyone under the age of 18 years from registering an Account and using our services.
- (b) We recommend that you establish personal limits for participating in our Lotteries and we in no way endorse or advocate participating in our Lotteries as a method of deriving income. Lottery is a game of chance and winning is a matter of luck. Should you have concerns about your participation in lotteries, we would encourage you to contact a suitable counselling organisation, for example, Gambling Help Online. As well as restricting players to the advised spending limits, our aim is to prevent the gambling of our players from having a detrimental effect on their lifestyle and that of their families.
- (c) As part of our commitment to responsible gambling, we engage in behavioural modelling to assist us in providing support to our Account Holders who may be experiencing problems with gambling. By registering for an Account with us, you consent to us using your Account Data as part of these activities.
- (d) We may in our absolute discretion temporarily or permanently close your Account and/or exclude you from purchasing any or all of our Lotteries where we, in our absolute discretion, deem a responsible gambling risk is posed. If we do this, we will take all reasonable steps to remit the total balance of your Account to you.
- (e) If you feel that you have a gambling problem and want to prevent yourself from playing, please either contact our customer support team at support@lotteryoffice.com.au and request self-exclusion or alternatively, log into your Account, go to "My Account/Account Status" to close your Account and select the reason for closing your Account as "I have a gambling problem". Your details will be added to our exclusion list, barring you from future play with us. We may also disclose our exclusion list with government authorities as part of our community problem gambling initiatives.
28. Privacy
- (a) We collect information about you from your Application, from your transactions and use of our Website/App. This information may include your name, contact details, date of birth, identification details and details relating to your transactions and use of our Website/App. We collect this information for the purpose of assessing and processing Applications, for the administration of your Account, for carrying out marketing, planning, product development, administration of our Website/App and research. If you do not provide all the information requested in the Application, we may not be able to process your Application.
- (b) You authorise us to disclose the information provided by you to us, to our related body corporate (as defined in the Corporations Act 2001 (Cth)), relevant financial institutions, agents, sub-contractors and professional advisors for the purpose of verifying your identity and validating and obtaining authorisation for any deposits and withdrawals made by you, for the administration of your Account, Website and App, for carrying out marketing, planning, product development and research.
- (c) We may use your Account Data for behavioural modeling to assist us in identifying Account Holders who may be at risk of problem gambling. If you do not consent to us collecting your Account Data for behavioural modeling, we may be unable to process your Application.
- (d) By opening an Account with us, you consent to us contacting you by any communication means, for example, email, SMS, letter, phone and social media, to provide you with information about your Account. You will also be provided with the opportunity to opt into receiving direct marketing about upcoming events, promotions, new products and services or other similar opportunities. Each time we contact you with direct marketing, we will provide you with an opportunity to opt-out from receipt of direct marketing activities and we will promptly act on your request to opt-out. If you do not wish to receive direct marketing, you can opt out of any or all of them at any time by updating your communication preferences within your Account or by contacting us.
- (e) Your personal information will be dealt with in accordance with our Privacy Policy which you can access here. You will be entitled to gain access to information which we hold about you unless otherwise specified by law. We may charge a fee for our reasonable costs in providing you with access to your personal information.
- (f) This clause survives termination of your Account with us.
29. Dispute Resolution
- (a) If a party claims that a dispute has arisen, it must notify the other party in writing of the nature of the dispute (Dispute Notice).
- (b) Neither party may start any legal proceedings (including mediation) relating to the dispute unless it has followed the steps in this clause, except as otherwise indicated in clause 29(h).

(c) Steps for resolving the dispute are as follows:
- (i) both parties must try to resolve the dispute within 10 business days after receiving the Dispute Notice, or a longer period if mutually agreed;
- (ii) if the parties fail to resolve the dispute within that time, they must refer the dispute to a nominated senior representative of The Lottery Office, who will meet and discuss the dispute promptly with the aim of resolving it; and
- (iii) if the nominated senior representative fails to resolve the dispute within 20 business days after the referral, either party may submit the dispute to a mediator for consideration in accordance with clause 29(d).
- (d) Subject to the powers of the Director under the Act, the regulations and our license agreement, any claim or dispute arising out of or relating to these Terms and/or your use of the Website/App shall be resolved by mediation conducted in Darwin, Northern Territory of Australia in the English language by a sole mediator (Mediator) in accordance with the Guidelines for Commercial Mediation of the Australian Disputes Centre, which form part of this Agreement (ADC).
- (e) You agree to the ADC and the location as described in clause 29(d) for resolving any claim or dispute arising out of or related to these Terms and the use of our Website and/or App.
- (f) If the parties are unable to agree on a choice of the Mediator within fifteen (15) days of one party demanding mediation, then the ADC shall make the appointment of a Mediator who is neutral to the parties in dispute. The Mediator will be bound by the provisions of these Terms.
- (g) Upon rendering a decision, the Mediator shall state in writing the basis for the decision, and the written decision of the Mediator shall be binding on the parties. Any judgement upon the award may be entered and enforced in any court of competent jurisdiction.
- (h) Notwithstanding the foregoing, we may seek injunctive relief in any appropriate court.
- (i) Each party shall bear its own legal, other costs and expenses in connection with the mediation.
30. Indemnity and Limitation of Liability
- (a) Nothing in this clause 30, affects your rights under the Australian Consumer Law. Our Lotteries come with guarantees that cannot be excluded under the Australian Consumer Law.
- (b) Except to the extent that guarantees under the Australian Consumer Law cannot be excluded, we will not be liable to you for any Loss, Claim or Liability arising from or deemed or alleged to have arisen from or caused by our Website/App or content within our Website/App, your use or your inability to use or access our Website/App or access your Account, failure to process a Lottery entry or Lottery Ticket, delays in operation or transmission, communication line failures, or any errors or omissions in content save to the extent that such Loss, Claim or Liability arises directly from our gross negligence or wilful misconduct or that of any of our officers, employees or agents. To the extent that any such incident arises due to a Lottery entry and/or Lottery Ticket, we reserve the right to cancel a Lottery Ticket relating thereto and our sole liability to you shall be the cost of the Lottery Ticket.
- (c) You agree that we do not guarantee that a Foreign Lottery operator will carry out any Lottery Draw, honour a matching Foreign Lottery Ticket to that of an International Lottery Ticket and/or pay any applicable Lottery prizes. Failure to do so on the part of the Foreign Lottery operator in no way makes us liable to pay out any prize amount equivalent to the relevant matching Foreign Lottery prize. Should the Foreign Lottery operator fail to do so you hereby release us from any liability in relation to the same, and agree that our sole liability to you shall be the cost of the International Lottery Ticket.
- (d) In any and all cases of gross negligence and wilful misconduct by us in regard to your Lottery Ticket (including any Lottery entries submitted by you), any liability arising therefrom will be limited to the amount equal to the prize winnings (if any) that we have received from the Foreign Lottery operator (where applicable), together with the cost of your Lottery Ticket.
- (e) We will not be liable under any circumstances for any indirect, special, economic or consequential loss or damage suffered by any entity including without limitation loss of income, profits, business, goodwill or data, or loss of anticipated savings.

(f) To the extent permitted by law, you agree to indemnify us, our officers, employees and agents from and against any Claims, Loss and Liabilities:
- (i) arising directly or indirectly out of your use of our Website/App and any content within our Website/App; or
- (ii) from any violation by you of the Terms (including negligent or wrongful conduct by you), except for any Loss, Claim or Liability which results directly from our gross negligence or wilful misconduct or that of our officers, employees or agents.
31. Set-Off
- We may at any time, without notice to you, set off any Liability owed by you to us including, without limitation, from any Account in your name.
32. Governing Law
- Your use of these Terms is governed by the laws of the Northern Territory, and you submit to the jurisdiction of the Northern Territory. We make no representation that our services with the laws of any country outside Australia. All rights not expressly granted herein are reserved. Void where prohibited.
33. Assignment
- We may assign the rights and obligations under these Terms to a related body corporate. We will give you notice no later than 30 days after any such assignment occurs. If you consider the assignment is detrimental to you, you may close your Account without being liable to pay any fees or charges to us.
34. Variation of Terms

(a) We may vary the Terms by:
- (i) getting your consent; or
- (ii) complying with this clause
- (b) The steps we must take will depend on the type of variation.

(c) If we reasonably consider that any change to the Terms is likely to:
- (i) benefit you;
- (ii) be of no or immaterial detriment to you,
-
(d) If we reasonably consider that any change to the Terms is likely to be material, we will notify you of the change to the Terms by our choice by one of the following:
- (i) the next time you access your Account using our Website/App, at least 30 days prior to the change occurring. You may not see the notice until after the change has occurred if you do not access your Account using our Website/App before the change comes into effect;
- (ii) by mail to an address provided to us by you, sent by us at least 30 days prior to the change occurring; or
- (iii) by email to the email address provided to us by you, sent by us at least 30 days prior to the change occurring.
- (e) The notification in clause 34(d) will specify the date of commencement of the change to the Terms.
- (f) If you are a Verified Account Holder and consider that any change to the Terms is detrimental to you, you may close your Account during the 30-day notice period without any fees or charges, notwithstanding clause 19 of these Terms.
35. Waiver
Any non-enforcement by us of any of our rights under the Terms will not constitute a waiver of those rights.
36. Notices
Where we are required or permitted to give you notice under the Terms we may do so:
- (a) If the notice is about a variation to the Terms, we may give you notice by complying with clause 34(d);

(b) Otherwise, we may give you notice in any way, including by:
- (i) giving you the information in person (whether it be provided by us or our agents);
- (ii) giving you the information by telephone, mail, email or any other form of communication using the contact details you give to us;
- (iii) making the information available within our Website.

(c) Where we give you notice:
- (i) in person or by telephone, it is taken to be received by you at the time we give it;
- (ii) by mail, it is taken to be received by you on the 5th business day after posting;
- (iii) by email, it is taken to be received by you when the email is sent unless we receive an automated notice that the email is not delivered;
- (iv) by making information available within our Website, it is taken to be received by you either the next time you access your Account or 10 business days after we make the information available within our Website, whichever occurs first.
- (d) Where any law requires or permits us to give information to you, you consent to that information being given by electronic communication.

(e) Where you are required or permitted to give us notice under these Terms, you may do so by giving us the notice by:

- (ii) through the Website (where available); or

37. Disclosure of Winner Details
We reserve the right to disclose non-identifiable information about lottery winners and their entries for publicity, marketing, and media purposes without your consent. This may include general descriptions such as the winner's region, amount won, and general background story. Such information will not identify the winner personally, and we will not publish names, photographs, or other identifying information without the winner's consent.
38. Definitions
The following definitions apply to these Terms, unless a contrary intention appears in these Terms:
Account | means the account established by you via our Website or App; |
Account Data | means the transactional data relating to your Account, including but not limited to, win/spend history, Lottery type selection/ outcomes, bonuses earned and expended, customer service records and responsible gambling activity; |
Account Holder | means a person that has been accepted by us as either a Verified Account Holder or an Unverified Account Holder following submission of an Application for registration of an Account; |
Act | means the Gaming Control Act 1993 (NT) which incorporates the Gaming Control (Internet Gaming) Regulations 1998; |
Application | means your application for registration described in clause 4; |
App | means our app that can be found in Apple's App Store or Google Play; |
Australian Consumer Law | means the Competition and Consumer Act 2020 (Cth); |
Claim | means any claim, action, proceeding, litigation, obligation, investigation or demand made against the person concerned however it arises and whether it is present or future, fixed or unascertained, actual or contingent of whatever description; |
Foreign Lottery | means the lotteries described in clause 7(b)(i) (right hand column) owned and operated by a foreign lottery operator; |
International Lottery | means our Lotteries described in clause 7(b)(i) (left hand column); |
Liability | means any debt or other monetary liability or obligation however it arises and whether it is present or future, fixed or unascertained, actual or contingent of whatever description; |
Loss | includes any direct, indirect or consequential loss, loss of chance, damage, Liability, cost or expense however it arises and whether it is present or future, fixed or unascertained, actual or contingent of whatever description; |
Lottery(ies) | means our standard and international lotteries specified in clause 7; |
Lottery Draw | means the specific draw date and time for our Lotteries as specified on our Website/App and in the Rules; |
Lottery Ticket | is a detailed record of a Lottery entry purchased pursuant to an entry form; |
Our, us and we | means Global Players Network Pty Ltd, ABN 41 102 371 335 (trading as The Lottery Office); |
Regulator | unless otherwise defined means the Senior Director for Racing, Gaming and Licensing for the Northern Territory of Australia which is the responsible regulatory authority under the Act; |
Rules | means the rules made or adopted by us which govern the operation and supply of our Lotteries, as approved by or notified to the relevant gambling Regulator; |
Standard Lottery | means the Lotteries described in clause 7(a); |
Terms | means these terms as they apply to your Account, your use of our Website and App and our Lotteries; |
Third Parties | means any person who is not you or us; |
Unverified Account Holder | means a person whose identity, age and place of residence have not been verified in accordance with our identification procedures and a person who has advised us of a change to their personal details, which has not been verified in accordance with our identification procedures; |
Verified Account Holder | means a person whose identity and age have been verified in accordance with our identification procedures; |
Website | means our website located at www.lotteryoffice.com.au; |
You and your | means the Account Holder. |
39. Interpretation
-
(a) In these Terms:
- (i) headings are for convenience only and do not affect the interpretation;
- (ii) a word importing the singular includes the plural (and vice versa), and a word indicating a gender includes every other gender;
- (iii) if a word or a phase is given a defined meaning, any other part of speech or grammatical form of that word or phrase has a corresponding meaning;
- (iv) references to any legislation or to any section or provision of any legislation includes reference to that legislation as amended, re-enacted or replaced;
- (v) a reference to "includes" in any form is not a word of limitation; and
- (vi) a reference to "$" or "dollar" is to Australian currency.
